Documentary Film Groups File Lawsuit Challenging DOS Requirement That Visa Applicants Provide Social Media Indentifiers

Earlier this month, two documentary film organizations filed a lawsuit challenging DOS rules requiring nearly all individuals who apply for U.S. visas from abroad to register their social media identifiers with the U.S. government. The plaintiffs allege that this registration requirements and related retention and dissemination policies exceed the Secretary of State’s statutory jurisdiction and authority, violate the First Amendment, and are arbitrary and capricious. They seek declaratory and injunctive relief, as well as an order requiring the defendants to expunge all information collected through the registration requirement.
